On January 1, 2021, The Town of Truckee adopted a Short Term Rental Ordinance. On May 12, 2022 the Short Term Rental Ordinance was amended to cap the total number of Short Term Rental Certificates (STR’s) to 1,255. As of November 8, 2022 all of the STR’s have been taken and there is a wait list of approximately 140 applicants.
The Ordinance was passed in an effort to preserve neighborhood character and to address nuisances such as noise, parking and the proper disposal of trash in in bear proof containers. In addition the ordinance seeks to enforce compliance with building and fire codes before an STR is issued. Maximum occupancy is 2 people per bedroom plus two additional people excluding children under 13.
An STR is defined as residential dwelling with the purpose to provide lodging from 1 night to a maximum of 30 nights. It includes single family homes, condominium, townhomes, duplexes, accessory dwelling units, multi family dwelling units, bedroom within an existing dwelling unit, tiny home, cabin, or yurt. Hotels and Bed & Breakfasts are exempt from having to obtain an STR, but are still subject to transient occupancy tax (TOT). TOT is 12% plus a Truckee Tourism Business Improvement District (TTBID) of 1.25% for a total fee of `13.25%
There will be a phase out of Accessory dwelling units (ADU’s). ADU’s that had a STR prior to March 22, 2022 will be allowed to renew their STR certificate, but if not renewed the homeowner will be unable to reapply.
STR Certificate holders will be required to designate a contact person available 24/7 to respond to complaints within 30 minutes of being notified and have 60 minutes to resolve the violation.
Both guests and property owners may be cited and fined for non-compliance, with citations up to $1,500 per day for the first violation, up to $3,000 per day for the second violation, and $5,000 per day for each additional violation. After 3 strikes, a rental’s registration certificate will be revoked and the homeowner must wait a minimum of 12 months before they are eligible to apply for a new STR or go on the waiting list.
STR’s are valid for 1 year from the time they are issued and must be renewed every year. There is no minimum number of days a property must be rented in order to renew an STR. If a property changes ownership, the STR is revoked and the new owner must apply for a new STR. New homeowners must wait a minimum of 365 days before they are eligible to apply for an STR.
A Short Term Rental Certificate with an annual renewal cost $300 and there is a $100 fire inspection fee required every 3 years to the Truckee Fire Protection District.
